“Lowell 6” file motion to dismiss

The “Lowell 6″ who were arrested for trespassing on the Lowell Mountain wind site expected to have a jury draw and go to trial in the next week or two. Yesterday they learned that the court has put off hearing their case until August.
Meanwhile, their legal counsel filed a Motion to Dismiss based on precedent in other states that it is an abuse of process for the state to intervene where a legitimate property ownership dispute exists. You can read the filing here: Motion to Dismiss 6-18-12
