ELLICOTTVILLE – EverPower Windholdings Inc. is unlikely to begin construction his year on its 29-turbine wind farm in the town of Allegany, a company official told the Cattaraugus County Industrial Development Agency on Tuesday.
Kevin Sheen, senior director of development for EverPower, said the 2011 Cattaraugus County Concerned Citizens lawsuit and the group’s notice that it would appeal the lawsuit’s dismissal delayed the project past the Dec. 31, 2011, deadline to qualify for about $31 million in federal subsidies.
“The lawsuit knocked us off of our path,” Mr. Sheen told the IDA board members. “We’re not a company that takes development risks during a lawsuit.”
