Wind opponents ask siting chief’s removal

PROSPECT – An attorney representing a local group opposed to a commercial wind project in Prospect has reported to the Connecticut Siting Council that its chairman who is a Fairfield probate judge remarked on the proposal following a hearing in court last week.

Attorney Jeffrey J. Tinley, who represents Save Prospect Corp., submitted a letter March 22 to the siting council, reporting an “ex parte” communication on March 18 by the council’s chairman, Daniel F. Caruso, who is a judge of probate in Fairfield.

The conversation centered around a pending petition by BNE Energy Inc. of West Hartford to build two wind turbines at 178 New Haven Road. The letter does not specially call for any action against Caruso, but Tinley stated he is required to share this communication with his client and other parties involved and to report it to the siting council.

Tim Reilly, Save Prospect president, and Emily A. Gianquinto, an attorney representing FairWindCT, another group opposed to the project, both said this is grounds for Caruso to remove himself from the proceedings.
