Landowners seek to stop wind farm

Opponents of a massive wind farm granted a permit by the Dickinson County Board of Adjustment vowed to continue the fight. They have hired Des Moines lawyers to try blocking construction.

Attorneys David Fautsch and Elisabeth Tursi have filed a motion with the court in Dickinson County. The plaintiffs are listed as landowners Kristine Van Kleek, Aaron Janssen, the Sidles Family Trust; and are joined in the petition by the group calling itself Dickinson County Concerned Citizens – all who say they live within 3 miles of the project and will be physically, emotionally, or financially harmed if it’s allowed to proceed.

The case claims that the Board acted illegally, arbitrarily, capriciously, in excess of its statutory authority, and in violation of local ordinances and constitutional protections. Thirty-four different bullet points claim that the Board acted beyond the scope of the County’s Comprehensive Land Use Plan, and further charges secret – or at least poorly publicized – meetings in which decisions were made.
