Letter to Shell and EDF regarding offshore wind projects

Please find the enclosed letter and report sent to the New Jersey Board of Public Utilities (BPU) today. The letter is signed by a growing coalition – currently more than 40 – of New Jersey towns and citizen groups opposing any BPU award of new or revised contracts to your U.S. partnership Atlantic Shores Offshore Wind LLC. The letter and report detail the economic and ratepayer impacts and potential violations of state law any such awards would present.
As you are aware, offshore wind development off the shores of New Jersey no longer presents a viable economic proposition without significant above-market ratepayer subsidies. In pursuit of its offshore wind generation goals, the BPU has ignored its clear statutory authority and its obligation to protect NJ ratepayers from unjust and unreasonable electric rates.
Instead, BPU is imposing the cost of these above-market subsidies on residents and businesses here. In doing so, the BPU places your Atlantic Shores partnership in legal jeopardy and risks stranding investments in these projects with litigation from municipalities, organizations and individuals throughout the state. We believe these pending legal challenges will prevail for the reasons outlined in the attached documents.
Respectfully, we urge you to consider these challenges wisely. You have an opportunity now before any awards are granted and final investment decisions are reached to best serve the interests of investors and shareholders by reconsidering your commitment to the proposed Atlantic Shores projects.
Opposition to offshore wind in NJ is growing in tandem with public awareness of the projects here. Groups and municipalities have joined forces and filed multiple lawsuits against the BPU (Third Solicitation), the New Jersey Department of Environmental Protection (Coastal Zone Management Act), and Atlantic Shores itself. We are confident that litigation and our pending challenges will prevail in courts. We will continue to use all tools available to raise awareness and to halt the costly impacts of ocean and coastal community industrialization including additional litigation, public hearings, social awareness campaigns, investor outreach, rallies and demonstrations among others.
Rest assured, we will defend at all costs our local, state and national treasure – the New Jersey Shore.
