Windfarm firm charged over landslide death

A company director has been returned for trial in relation to charges arising out of the death of a worker who was killed in a windfarm landslide.

Denis Moriarty, The Kerries Limited was served with four volumes of a book of evidence relating to a landslide in December 2016 at Derrysallagh wind farm, Glen County Sligo which claimed the life of Patrick McCaffrey.

In all there were six counts before the court brought under the Safety Health and Welfare at Work Act 2005.

The DPP has directed the case proceed on indictment to the Circuit Court.

It is alleged the company, with registered offices at Monavalley Business Park, Tralee, built a floating road in a high risk area of peatland and as a result Mr McCaffrey died.

It’s alleged the company failed to obtain an appropriate assessment and design from a geotechnical engineer prior to the construction of the road.

Mr Moriarty was returned for trial to the next sittings of the Circuit Court in Sligo on November 16th.
