Turbine noise complainant speaks out against commissioners

At the Oct. 10 Huron County Board of Commissioners meeting, corporate council Steve Allen stated he can’t imagine what it’s going to cost in litigation to enforce the wind ordinance. He also stated he never even thought about the non-conforming use issue until John L. Bodis brought it up. He also brought up takings, and to quote Mr. Allen, he said the county is heading for a train wreck. Unfortunately, the train left the station 10 years ago, and now the chickens are coming home to roost.

To sum it up, there was a failure to assess just about everything. If a federal judge would review the dossier, including video of county officials’ actions and inactions pertaining wind energy regulations and the complaint process, he would most likely deem there was no apparent justification for the staggering deficiencies of these regulations other than to accommodate wind developers. Heritage Energy has never proven compliancy in Big Turtle Phase 2, yet no corrective action has been taken against them.

I have followed the complaint process but will not allow a sound study to be done until county officials are willing to hire a qualified acoustician with years of experience assessing sound emissions from proposed wind farms and measuring the performance of completed projects. This is a must for the health, safety and welfare of not just me, but the citizens of Huron County. This is the duty of county officials, yet county officials repeatedly accuse me of being uncooperative. Commissioners now want my complaint voided.

Video footage taken on Oct. 10 of the commissioners’ meeting is very revealing. Huron County officials’ failure to assess numerous issues such as:

1. Inverse condemnation

2. Takings of private property

3. Partaking in creating a private nuisance

4. Lack of due process

5. Lack of due diligence

6. Defamation of character

7. Regulatory capture

8. Failure to follow its own complaint process

None of these said issues are arbitrary, unreasonable or capricious, and they are actionable. Hopefully this issue can be resolved.
