No ruling yet in WECS case

The court battle continues over Henry County’s wind turbine ordinance.

A special judge from Delaware County heard oral arguments Friday afternoon from different sides of the fight about the local Wind Energy Conversion System (WECS) rules.

At the heart of the issue is whether or not Henry County’s WECS ordinance holds water.

A group of citizens and landowners are calling it invalid. County leaders and an energy company looking to develop in northern Henry County say the rules are just fine.

It’s now up to the judge.

The judicial review was moved to Delaware County after Henry County Judge Bob Witham recused himself from the case. Delaware County Circuit Court 3 Judge Linda Ralu Wolf is special judge on the case.

Friday’s oral argument hearing was over a motion from energy company Big Blue River Wind Farm, LLC to dismiss the entire case.

The Henry County petitioners who originally asked for a review of the WECS ordinance counter-filed arguments against Big Blue River Wind Farm’s motion to dismiss.

Delaware County courts reported Monday that Judge Wolf has taken the arguments under advisement and has not made any ruling in the case.

The Courier-Times will continue to follow the challenge to the county WECS ordinance as it develops.
