Court challenges continue in wind case

Special Judge Linda Ralu Wolf has agreed to let Big Blue River Wind Farm, LLC file a two-in-one response by Oct. 21.

The wind farm company is embroiled in a judicial review court case filed by a group of Henry County residents who question the validity of the county’s wind turbine ordinances.

Big Blue River Wind Farm asked the judge in August to dismiss the case, claiming that the petitioners hadn’t followed the right channels and that Henry County courts weren’t the proper venue for the ordinance review.

The county residents responded by asking Judge Wolf to disregard certain pieces of the wind farm’s motion and to let the review continue, which is known as a Motion to Strike.

Attorneys for the proposed wind farm argued they should be allowed to reply to the Motion to Strike. They asked Wolf to allow the response to include support of Big Blue’s original Motion to Dismiss.

Wolf granted their request Sept. 25.

Big Blue River Wind Farm, LLC has until Oct. 21 to file its response.

The Henry County Commissioners will meet in special session from 5 to 9 p.m. Monday and Tuesday in the Henry County Courthouse, 101 S. Main St., New Castle, to review and discuss Henry County’s current wind energy conversion system (WECS) ordinance.

This is the ordinance at the heart of the current judicial review request.

Input from the public will be received concerning possible changes to the WECS ordinance.
