Falmouth powers down second wind turbine following court ruling

Falmouth Board of Selectmen ordered the halt of the operation of a controversial wind turbine after a Barnstable County Superior Court judge Tuesday, June 20, deemed the town-owned power source a nuisance.

Members met in emergency session around 6 PM after learning Judge Cornelius J. Moriarty II affirmed the Falmouth Zoning Board of Appeals’ position on turbines Wind 1 and Wind 2, said Town Manager Julian M. Suso. They will meet again in executive session—closed to the public—on Monday, June 26, to discuss the town’s options, Mr. Suso said.

Both turbines—Wind 1 was powered down in September 2015 also owing to legal action—have proven lightning rods for litigation. The first went up in 2009 and abutting property owners began citing the machines as the source of noise and health problems soon after.

The pair, located near the town’s wastewater treatment plant, have generated scores of meetings, headlines, letters to the editor and court cases since beginning operation.
