Clayton passes tall structures amendment; repeals local wind laws

CLAYTON – The Town Council passed an amendment to the town’s zoning ordinance that prevents commercial wind development in the town on May 10.

Amendment 40, also known as the “tall structures amendment,” will require property owners to obtain a special use permit for structures taller than 35 feet and an area variance for structures taller than 250 feet. It also prevents property owners from having wind energy facilities used primarily for selling electricity back to the grid on their properties without a use variance.

Town Supervisor David M. Storandt Jr. said the board also passed Local Law No. 2 of 2017, which repealed all previous local wind laws.

“Everything passed without any issue,” he said.
