Area Plan Commission rejects all Commissioners’ objections

The Area Plan Commission voted unanimously Tuesday night to reject all 11 objections made by the Clinton County Commissioners regarding the LUPAC/Wind Ordinance before a packed Circuit Court Courtroom on the third floor of the Clinton County Courthouse.

The five-member committee, headed up by new president Dan Sheets, took an hour to reject all of the Commissioners’ objections that were put forth in a December 15 public hearing held at Clinton Central.

“We went through each item line-by-line and had good discussion on each of them,” said Sheets. “I think sometimes the Commissioners were a little bit confused or misinformed on some of their items. Some of the items we just disagreed on because we had a consensus of our entire board at our one hearing. I think we pretty much made up our minds when we sent it to them the first time.”

The next move is up to the Commissioners, who can either accept or reject the objections from Area Plan.

“They will have to do something within 45 days,” said Sheets. “We may get it back to make additional revisions. They may accept our rejection and then ask us to come back and revisit some things which I would be fine with.”

The following were the objections the Commissioners raised at their Dec. 15 meeting:

Objection 1 – amend decibel level to 40.

Objection 2 – amend setback to 1760 feet from property line of non-participating land owner to edge of turbine.

Objection 3 – add 1/2 mile setback to county line.

Objection 4 – amend to show property value guarantee is required, not negotiable.

Objection 5 – transportation committee is created and governed by the Board of Commissioners.

Objection 6 – strike that the property value guarantee form is created with the help of the Clinton County Economic group and the Clinton County Council.

Objection 7 – amend that on insurance matters, the Area Plan Commission is replaced with Board of Commissioners and executive director is replaced with Commissioner President.

Objection 8 – amend to add commissioner to pre-planning meetings and remove area plan president.

Objection 9 – increase fine to $5,000 from $1,000 for road or bridge damage.

Objection 10 – amend 405.02 item 8 to read any modifications to be heard by Board of Zoning Appeals.

Objection 11 – amend 405.03 to read any modifications to be heard by Board of Zoning Appeals.

The next meeting for the Commissioners is Tuesday, Jan. 17, at 9 a.m., while the next meeting of the Area Plan Commission is Monday, February 6 at 7 p.m.
