Settlement eyed in wind farm lawsuit

ESCANABA – Representatives of Heritage Sustainable Energy, LLC and Garden Township have indicated that they are working toward a settlement on an ongoing lawsuit between them. This was discussed during a supplemental pre-trial hearing held in Delta County Circuit Court Monday morning.

The lawsuit in question concerns noise ordinances in Garden Township. Representatives of Heritage have alleged that these ordinances would not allow them to profitably operate its Garden Peninsula wind farm.

While the suit was originally set for a court date in November 2015, it did not go to trial at this time. Instead, both parties went into mediation after a number of supplemental pre-trial hearings. In this process, which they discussed Monday, they began to work towards reaching a tentative agreement.

However, any agreement would need to be reviewed by Garden Township and Heritage before it could be officially accepted. A supplemental telephone conference to discuss the parties’ progress will take place on Sept. 2 at 10 a.m. in circuit court.
