Cllr John Campbell wins High Court challenge against Minister’s wind farm ruling

The High Court has today upheld an appeal by Councillor John Campbell at a direction from former Minister for the Environment Alan Kelly dating back to 2014.

The then Chairperson of Donegal County Council took the appeal after Alan Kelly overturned a decision by the Council to impose new conditions on windfarms

In June 2014 the council agreed to a set back distance ten times the tip height of turbines from residential properties and other population centres.

Measures to protect the pearl mussel were also included in the development plan.

However later in the year, then Minister Alan Kelly issued a detailed directive overturning the Councils decision.

This was successfully appealed by Councillor John Campbell with the High Court today quashing the Ministerial direction of October 3rd 2014 and awarded his full costs following a settlement offered by the office of the minister’s legal team.
