Ohio’s Supreme Court ruled in a 5 to 2 decision that the second phase of the Buckeye II Wind Farm can proceed.

The proposed wind farm has been controversial in Champaign County and has divided much of the community.

Justice Judith French ruled the Ohio Power Siting Board’s initial offer to approve the project was not unlawful, and concerns brought up by opponents in the case did not affect the overall outcome of whether the project should proceed.

Justice Sharon Kennedy wrote a dissenting opinion, arguing the OPSB improperly rejected evidence of a “blade throw” incident at another wind farm. Overall, the wind farm is split into two phases and would include a total of about 100 turbines across Champaign County.
