Bourne plans legal action against South Plymouth turbines

Bourne Town Counsel Robert Troy on Jan. 26 said he would enter Barnstable Superior Court “within days” to initiate legal action that would try to halt turbine construction at Keith Mann’s South Plymouth cranberry tract.

Troy’s comment came after selectmen met in executive session to discuss the pending wind farm litigation against the controversial turbines.

Troy said future discussion about Bourne legal moves would be consigned to executive sessions with selectmen. “We will be heard in court,” he said.

Troy also said he has studied the Bourne Health Department record and its attempt at Bourne turbine-protection bylaw review, especially as that relates to “strategic efforts” related to enforcement.

Selectmen Chairman Steve Mealy, meanwhile, said a recent health board decision to send enforcement orders to Mann, his Future Generation Wind business, ConSolidated Edison, and Plymouth authorities were never issued.

Hyannis/West Yarmouth attorney Charles Sabbatt joins Troy as part of Bourne’s legal team against the industrial-grade turbines, three of which have been constructed with blades attached in Head of the Bay.

Troy said Sabbatt is “an excellent litigator.

Karen Gibides of Morning Mist Lane, Buzzards Bay, an abutter to the Mann turbines, wanted to know who would serve as a “contact person” to have questions about litigation answered.

Mealy said she should contact Town Administrator Thomas Guerino in that respect.

Residents opposed to wind farm construction met Jan. 26 in the Main Street Community Center. They were there to organize opposition to the turbines, which can be observed from across Buttermilk Bay as well as the Bourne Bridge.
