Court date set in Yates wind project suit

ALBION – The legal battle over permits issued for the construction of a meteorological tower for the planned Lighthouse Wind project will hit State Supreme Court in September.
In documents filed at the Orleans County Clerk’s Office, parties served by wind project opponents in July were informed that a introductory hearing will be held at 2:30 p.m. Sept. 8.
The focus will be the Article 78 proceedings sought by Save Ontario Shores, which has asked the court to annul a June 11 Town Board resolution granting a special use permit for the data-collection structure, the voiding of a building permit and declaration that the resolution violated the state’s law classifying the environmental review for the project.
Donna Rae Bane, a Yates resident whose farmland is the location of the tower; Apex Clean Energy, the Virginia firm pursuing the 200-megawatt wind energy project; and the Town Board were served by S.O.S. ahead of the town’s July 9 meeting.
