Six property owners in the towns of Richfield and Winfield have sued the Town of Richfield, its planning board and three individual planning board members in connection with the Monticello Hills Wind Power Project, the plaintiffs’ attorney said.
The lawsuit was filed in Otsego County Supreme Court on Friday. The plaintiffs say their constitutional rights were violated by the board twice approving the power project. Approvals for the project were approved in 2011 and 2013, but were struck down both times by the Madison County Supreme Court.
The six landowners claim their property rights were taken without due process or compensation.
The Town of Richfield officers were not open Friday for comment.
