Falmouth makes deal with turbine neighbors

The Falmouth selectmen and neighbors of the Wind 1 and Wind 2 turbines have agreed on a plan to cut the hours of operations for the town-owned turbines at the Falmouth Wastewater treatment Facility.

The agreement, while not the final word on turbines in Falmouth, came as part of a Barnstable Superior Court hearing in which Judge Christopher Muse was to rule on a preliminary injunction that could have had the effect of shutting down the turbines until a lawsuit which pitted turbine neighbors Neil and Elizabeth Anderson and the Falmouth Zoning Board of Appeals against the town of Falmouth could be settled.

The agreement reached Nov. 7 will have the turbines operate from 7 a.m. to 7 p.m. rather than the 5 a.m. to 9 p.m. schedule put into place last month to help the town operate the turbines in a financially sound way.

Falmouth’s town attorney Frank Duffy will brief selectmen on the agreement for an executive session discussion Nov. 18.

The two sides are due in court again Nov. 21 when Judge Muse is expected to issue a final ruling in the case. Neighbors are expected to submit to selectmen a list of those steps they believe must be taken for their opposition to end.
