Wind turbine lawsuit ordered to mediation

A group of homeowners claiming physical and financial harm from wind turbines has been ordered to seek mediation with Consumers Energy in a lawsuit filed earlier this year.

51st Circuit Court Judge Richard Cooper last week ordered the group that includes Kim and Nancy Van Nortwick; Cary and Karen Shineldecker; Jonathon and Shannon Ray; James and Mary Nichols; Fred and Susan Kaiser; Evelyn Bergaila; Kevin McVicker and Debora Harley; Daniel Connolly and Rebecca Mott; Jeanne Parsons; and Bill Parsons to seek a court-approved mediator with defendant Consumers Energy by Aug. 27.

If the parties fail to pick a mediator, one will be selected for them and they will share a $250 sanction levied by Cooper. Within 21 days of the Aug. 13 order, the mediator is to notify Cooper of the date and time for mediation.

Cooper has asked the parties to complete their discussions and mediation by July 1, 2014.

According to court documents, in the event that mediation is not successful, Cooper has scheduled a trial for two and a half weeks next October into November. The trial is scheduled at this time to start at 9 a.m. Oct. 20.
