Court asked to reverse regulator’s ruling on Nova Scotia wind farm

A Cape Breton company is asking the Nova Scotia Court of Appeal to reverse a provincial power regulator’s decision regarding a Lunenburg wind project.

Cape Breton Explorations Ltd. is one of eight independent power producers that are seeking to overturn a decision of the Nova Scotia Utility and Review Board regarding Nova Scotia Power’s involvement in the South Canoe wind project.

The UARB has approved Nova Scotia Power’s capital expenditure of over $93 million for the project, which actually involves two wind projects in Lunenburg County.

Nova Scotia Power owns 49 per cent of each project.

Luciano Lisi, head of Cape Breton Explorations, says his company will argue that because Nova Scotia Power was allowed to pass along its South Canoe costs to ratepayers, it had an advantage that competing bidders did not have.

An appeal hearing date has been set for Nov. 27.
