Lawsuit coming?

When the Tipton County Board of Zoning Appeals voted not to consider requested modifications of the setback requirements for the proposed Prairie Breeze Wind Farm, property owners who have signed leases with developer juwi Wind immediately claimed they’re being denied due process and a public hearing.

“The Tipton County Board of Zoning Appeals mdecision … denied the leaseholders the right to be heard on the issue,” John Cardwell said. “The BZA did not provide adequate public notice, was misleading in its intentions, and denied an appropriate public hearing to discuss the merits of the issue. This has left the leaseholders and other citizens no other choice but to consider all public options that are available to protect their rights as citizens and taxpayers in Tipton County.”

Opponents of the development with the Tipton County Citizens for Responsible Development were pleased with the decision to deny juwi Wind’s request to reconsider conditions placed on the Prairie Breeze Wind Farm.

“The BZA made its decision to require a 1,500-foot setback from a property line after listening to 8 hours of testimony in March,” the group said in a press statement. “The CRD believes the BZA acted responsibly by standing behind that decision, regardless of pressure to the contrary.
