Permit improperly granted for construction of wind turbines

Richfield, N.Y. – A permit for construction of wind turbines previously issued by the Richfield Town Planning Board was improperly granted.

The state Appellate Court recently ruled the planning board did not address the requirements of the town’s land use and building management ordinance.

The court did dismiss a previous state Supreme Court ruling that the board attend training sessions with the state Committee on Open Government because of violation of the Open Meetings Law.

After the board approved a six-turbine wind project along state Route 20, several town residents filed a lawsuit asserting that the planning board violated several laws. The lawsuit also named the wind developer and landowners who have entered into agreements with the company.

Ridgeline Energy, based in Seattle, and part of France-based Veolia Environnement, proposed the Monticello Hills wind project late last year. It would feature six 492-feet-tall turbines along Route 20 in Richfield.
