In an attempt to discern the intentions of the Hays Wind LLC project developers, Ellis County has asked attorney Dennis Davidson to draw up papers to lift a stay-and-tolling order issued by the court.
Ellis County Commissioners in November of 2011 explored the option of ending the stay-and-tolling order that was part of a 2009 settlement agreement. However, commissioners were told at the time by Jason Du Terroil of Iberdrola Renewables his company intended to pursue the Hays Wind LLC project but had been unable to lock in a power purchase agreement.
“It kind of sounds like they’re giving up on the project,” said County Administrator Greg Sund of the wind company’s intentions to move forward with a project in Ellis County. “I guess the way we’ll find out is the way they react to that request to lift the stay order.
“There isn’t any confirmation of anything that they’re doing or have not at this point. This is just an action to get this back on the table and see what they want to do with it.”
