Kingston BOH misses yet another public hearing deadline, pushes date for flicker hearing back 21 days

In the first order of business at Monday night’s Board of Health (BOH) meeting, BOH-member Dan Sapir informed his board that they had missed yet another deadline to advertise an upcoming hearing on shadow flicker.

The public hearing, which was planned for April 1, failed to meet a regulation (Chapter 40a, Section 11) that requires all public hearings be advertised at least 14 days in advance.

The public hearing scheduled for April 1 was first advertised in The Kingston Reporter on Friday, March 22, only 11 days before the April 1 date.

It is the second time in as many months that the BOH has missed the deadline to advertise a public hearing on shadow flicker from Kingston’s industrial-sized wind turbines.

BOH staffers Linda Randall and Henny Walters said last Friday was the earliest possible date they could advertise the hearing due to printing policies at the Reporter.

Longtime BOH-member Bill Watson lobbied for a rescheduling of the public hearing, despite the Massachusetts Clean Energy Center’s offer to complete a flicker study for the Town of Kingston at no charge. “It’s going to be more information for us to make a [shadow flicker] regulation,” Watson told the BOH.

According to Health Agent Henny Walters, the BOH’s public hearing on shadow flicker has been rescheduled for three weeks later on April 22.

The public hearing has not yet been publicly posted on KingstonMass.org.

Despite the cancellation of next Monday’s public hearing…the show will go on. The BOH still plans to meet on Monday evening in the Town House with an agenda addressing articles on the warrant for Kingston’s upcoming April 6 town meeting.
