Whalerock wind turbine hearing postponed

CHARLESTOWN – A Washington County Superior Court hearing on the continued dispute between the town and the developer of two proposed wind turbines was postponed Monday due to a scheduling conflict involving legal counsel in the case.

The town and Whalerock Renewable Energy LLC will make their arguments March 11 at 9:30 a.m. in the courtroom of Associate Justice Kristin Rodgers.

The Town Council, which opposes development of the turbines on an 81-acre site just north of Route 1 off Kings Factory Road, is challenging the Zoning Board of Review’s November decision that Whalerock’s application is complete, allowing the company to apply for a special use permit that would allow the project to go forward. It contends the company needs approval from the Planning Commission.

Larry LeBlanc, a local developer who seeks to build the turbines on land he recently sold to a Connecticut company, N.I.N., and intends to lease back for the project, will argue that the Planning Commission can act only in an advisory role and seek clearance for a zoning board hearing on the permit.
