Judge to hear Scituate turbine arguments Monday

A Scituate couple will ask a Superior Court judge Monday to shut down the town’s wind turbine at least until their pending lawsuit about the turbine’s alleged health hazards is resolved.

Mark and Lauren McKeever, who live 640 feet from the 390-foot-tall turbine off the Driftway, filed a motion Friday requesting a preliminary injunction against the town’s Board of Health. Judge Charles Hely will preside over a 2 p.m. hearing Monday at Brockton Superior Court, and will hear arguments from both the McKeevers and the town of Scituate’s attorney, according to Tanya Trevisan, the McKeevers’ attorney.

Hely could decide as soon as Monday whether to shut down the turbine until the McKeevers’ lawsuit concludes. The McKeevers sued the Board of Health last month, asking the court to shut down the turbine because they say the turbine’s noise and shadow flicker have negatively impacted their family’s health.
