Windwise won’t appeal judge’s decision on siting

FAIRHAVEN – Windwise attorney Ann DeNardis said Monday the group won’t appeal a judge’s decision on the siting of one of the wind turbines. A judge ruled a few weeks ago in the town’s favor.

“The plaintiffs have opted not to appeal,” Ms. DeNardis said Monday after attending a Board of Health meeting with members of Windwise.

She added, “At this time we will pursue other avenues.” Ms. DeNardis said they were not ready to make their plans public yet.

Judge Lloyd Macdonald ruled last month that the north turbine’s siting is not invalid just because it was built on Lot 9 instead of Lot 8A as originally approved by Town Meeting. He said Town Meeting members approved the general location near the wastewater treatment plant.
