Allegany residents weigh in on removal of wind overlay district

ALLEGANY – Ten people spoke in favor of the town of Allegany removing the wind overlay district and one spoke against it during a public hearing on the matter Wednesday at the Allegany Senior Center.

The hearing, conducted by the town board, gave area residents an opportunity to address the issue of the removal of the overlay district in the Chipmonk and Knapp Creek areas. Allegany Wind, LLC, a subsidiary of EverPower, which has plans to construct a 29-turbine wind farm in the hilltop areas, recently filed a lawsuit against the town. In particular, the lawsuit claims that the removal of the overlay district would ban the previously approved wind farm and violate the contract agreements.

Allegany Town Supervisor John Hare addressed the crowd of several dozen people at the opening of the hearing and noted that he and the town officials are “not undoing the language in the zoning ordinance that allows for the creation of such zones.”

“What we’re specifically seeking is your comment on whether the town board should remove the special district created in Chipmonk,” Mr. Hare explained.
