Board tables escrow talk, may remove wind overlay

By Kate Day Sager Olean Times Herald | www.oleantimesherald.com 26 September 2012

Allegany Town Board members agreed Tuesday to table discussions on an escrow payment that hasn’t been paid by EverPower Wind Holdings Inc. and to set a public hearing for the proposed removal of a wind overlay district.

The hour-long meeting, held at Allegany Town Hall, was attended by close to three dozen people. No EverPower officials were in attendance.

Town Supervisor John Hare said that when he placed the EverPower host agreement on the agenda, he thought the wind energy company would have paid the town the $500,000 escrow fee which was due Monday.

“We were kind of expecting that EverPower, at the last minute, would make the payment on the escrow agreement, but they haven’t,” Mr. Hare said. “The letter has gone out to EverPower to notify them that they are in breach of that agreement. From my perspective, it seems kind of a moot point to discuss any further modifications in that agreement” rather than act on the issue.
