Richfield citizens group prevails in lawsuit against wind developer

Acting Supreme Court Justice Donald F. Cerio, Jr. annulled the SEQRA Negative Declaration and Special Use Permit issued last November by the Town of Richfield Planning Board to Monticello Hills, LLC to construct six 492-ft wind turbines and related infrastructure in the western portion of Richfield.

The decision comes as the result of an Article 78 lawsuit brought by diverse group of 34 petitioners from the Towns of Richfield, Winfield and Columbia to stop the project. In addition to annulling the permit, Judge Cerio ordered the Town of Richfield Planning Board to attend training by the Committee on Open Government, which will also be open to the public.

The decision comes as very positive news to the members of Protect Richfield, a citizens’ group organized in 2011 to oppose the project and other industrial developments not in keeping with the rural, agrarian nature of the Town of Richfield and surrounding areas.

Any questions regarding the decision may be referred to the Plaintiffs’ attorney, Douglas H. Zamelis, 8363 Vassar Drive, Manlius, NY 3104. (315) 682-0724 or by email dzamelis@windstream.net
