Conservancy sues over information act issues

American Bird Conservancy, which works to protect native birds and their habitats in the Americas, in June sued two United States agencies for failure to meet deadlines required by the Freedom of Information Act.

In 2011, ABC filed six requests for U.S. Fish and Wildlife Service correspondence with wind developers, as well as results of bird and bat impact studies at controversial wind developments in 10 states. FWS referred one request to the Bureau of Indian Affairs. ABC claims none of the requests were fulfilled within the required 20 working days.

“… Some DOI offices have not sent a single document that we asked for, even though the agencies were legally required to do so more than seven months ago,” said Kelly Fuller, wind campaign coordinator for ABC.

The requests were in regard to proposed and existing wind energy projects in southwest and midwest states and Florida, where projects could impact eagles, federally designated threatened and endangered species and night-migrating songbirds.
