Citizens group opts to drop wind farm lawsuit

CHIPMONK â€“ After much thought and discussion Wednesday, the Concerned Citizens of Cattaraugus County organization voted unanimously to drop a lawsuit in which it asked for a permanent injunction against the construction of a 29-turbine wind farm by EverPower Wind Holdings Inc.

During a meeting held at the Chipmonk Community Center, several Concerned Citizens members were advised by Gary Abraham to drop the lawsuit that is currently in state appellate court. Mr. Abraham, who is an attorney for the group and a resident of Allegany, has advised the group for the past several years in its opposition to the wind farm project proposed for the ridgeline areas of Chipmonk and Knapp Creek in the town of Allegany. The project was approved in August of 2011 by the previous town board, but since then it has been thwarted by the Concerned Citizens lawsuit. Other impediments to the project include EverPower’s difficulty in securing a route for transporting materials to the sites.
