Wind company takes legal action in Canada

AMHERST – An $8-million legal dispute between two partners in the Amherst wind project has been extended to Canada.

A month after filing a lien in court in Indiana, H.B. White Canada Corp. has done the same under the province’s Builders’ Lien Act against Suzlon Wind Energy Corporation and SP Amherst GP Inc. for its portion of the $61-million contract.

The amount of the lien, representing the amount due, is $8.35 million.

H.B. White alleges it is owed the money for work done on the wind farm just oustidet Amherst.

Documents were filed in the Nova Scotia Supreme Court on Tuesday.

The company argues that while the work has been completed, Suzlon “in breach of its obligations, express or implied, has failed, refused or neglected to pay White in full for the work.”

H.B. White is claiming payment for what’s owed or, in lieu, the sale of lands near the town it claims are owned by SP Amherst GP Inc., a surrogate company that manages the assets of the wind farm on behalf of partners Sprott Power and Firelight Infrastructure Partners LP of Toronto.

H.B. White was contracted to erect the 15 turbines, nacelles and blades associated with the 31.5-megawatt wind project that went into operation several months ago and was officially opened by Premier Darrell Dexter last month.

Suzlon supplied the turbines project.

When the U.S. court action was commenced in June, company spokeswoman Michelle Montague said it’s not unusual for liens to filed at the end of a project.
