Clear Skies Over Orangeville files another appeal

ORANGEVILLE – Clear Skies Over Orangeville is appealing a Feb. 22 decision by state Supreme Court Judge Patrick NeMoyer.

The group opposing the planned Stony Creek Wind Farm had sued the Town Board and Stony Creek LLC for issues including the project’s cumulative environmental impact and noise levels.

NeMoyer dismissed the claims entirely. He ruled the project’s environmental factors were thoroughly analyzed, including potential adverse impacts and mitigation.

CSOO is arguing northern harriers, bald eagles and other birds travel through the project and nest in forest south of the project.

The group said in a news release it will monitor the project and notify federal wildlife officials at the first sign the project has killed protected birds. It will also monitor and insist on sound-level compliance.

An earlier lawsuit was dismissed by NeMoyer in 2010. CSOO appeals were unsuccessful.
