CARRE wind turbine appeal hearing continues into afternoon

Court hearings began late this morning, adjourned for lunch early this afternoon and were to be back in court at 2:15 in the request by Citizens Alliance for Responsible Renewable Energy, which is seeking an injunction to stop the construction of Lake Winds Energy Park being built in Riverton and Summit townships.

In a packed Mason County courtroom before 51st Circuit Court Judge Richard I. Cooper, attorneys for CARRE presented the organization’s case for the injunction as an attorney representing Consumers Energy frequently objected to the arguments being presented. An attorney is also present representing the Mason County Zoning Board of Appeals.

Earlier this year the planning commission approved two separate special land use applications from Consumers Energy. One was for seven meteorological towers in Riverton and Summit townships and the other for the Lake Winds Energy Park – 56 nearly 500-foot-tall wind turbines. CARRE appealed the planning commission’s decisions to the ZBA, which backed the planning commission’s decision and CARRE then took the issue to 51st Circuit Court.

Today’s proceedings include an evidentiary hearing and a motion to dismiss on the met tower appeal. Also on the schedule, and involving both appeals, is a motion for a stay of proceedings or injunction of the pending appeal and a request to consolidate the cases.
