Mediation in town turbine suit Nov. 15

A mediation session is set for Nov. 15 between the Town of Barnstable and Larkin Enterprises Inc. of Lincoln, Maine, over the awarding of two wind turbines to another firm in 2010.

Larkin Enterprises Inc. filed a complaint in the U.S. District Court of Massachusetts against the town in March 2010 regarding the bidding process for the two turbines for the wastewater treatment facility. Among other things, Larkin argued that the town “wrongfully and in bad faith” rejected Larkin’s low bid and made shortcuts in the bidding to accommodate its tight schedule to ensure American Recovery and Reinvestment Funds, to the turbine manufacturer’s detriment.

The town denies that was the case and argues that no bidding laws were violated in awarding to a different contractor.

The two turbines, provided through Solaya Renewable Energy of Woburn, were installed and started spinning in June.

The mediation was ordered in a July decision by the magistrate judge handling the case in for the District Court of Massachusetts.
