Wind project sparks lawsuit

ALLEGANY – A lawsuit against the controversial wind farm in Allegany was recently filed by the Concerned Citizens of Cattaraugus County Inc. against several governing boards in the town of Allegany.

The lawsuit, submitted by Buffalo attorney Richard E. Stanton on behalf of Concerned Citizens, was filed with the Cattaraugus County Supreme Court last week against the town of Allegany Planning Board, the Town Board, the Zoning Board of Appeals, the Code Enforcement Officer and Allegany Wind LLC, also referred to as EverPower Wind Holdings Inc.

A notice of petition was filed Tuesday and a court date has been set for 1:30 p.m. Nov. 4 in Olean in front of Supreme Court Justice Michael Nenno, said Gary Abraham, attorney for Concerned Citizens. Mr. Stanton of Muscato and Shatkin PLLC, could not be reached for a comment regarding the lawsuit.
