New Generation asks Attorney General to reject revised turbine bylaw

BUZZARDS BAY – New Generation Wind is asking the Massachusetts Attorney General’s Office to reject the amended Bourne turbine-review bylaw passed by voters at the infamously blacked-out Special Town Meeting held May 9.

Boston attorney Diane Tillotson of the Hemenway & Barnes law firm, representing New Generation, last week challenged the legitimacy of the amended wind energy conversion systems bylaw that now limits to a handful of sites “anything but the smallest of turbines” in town.

New Generation plans a controversial four-turbine wind farm off Scenic Highway and Route 25 north of the canal with structures reaching 492 feet to the tip of the blades. The original plan was for seven turbines, which would have dramatically changed canal vistas along the lines of the two new 1.5 megawatt turbines that went up last month south of the canal on Camp Edwards.

The legal maneuvering continues in the New Generation review story, eclipsed in town this summer – perhaps – only by efforts to fund lifeguards. But the May 9 special town meeting and the size of the crowd it attracted remain memorable; and there may be legal implications now.

Tillotson in her Aug. 3 letter to the attorney general says her client was “clearly the target of the bylaw purportedly passed in May.” The bylaw revision is under routine AG review.
