$25-million suit dropped, building permit to be reinstated at future turbine site

A $25-million suit has been dropped against all parties named in an April suit regarding North Kingstown Green, where construction on a 427-foot turbine was halted after the revocation of the subdivision’s building permit. As of 9 a.m. this morning, all necessary materials were filed with the town to have the permit reinstated, according to turbine developer Wind Energy Development LLC’s spokerperson David Darlington.

The Town of North Kingstown pulled the permit on April 8 after discovering that signatures for a land swap had not been properly filed. Mark DePasquale (CEO of Wind Energy Development LLC), who plans to construct the turbine in his backyard at the subdivision, filed suit against several neighbors who had failed to file the necessary deeds.

Last year, land from DePasquale’s property on Thornton Way was swapped with open land owned by all homeowners at North Kingstown Green so the turbine’s 165-foot-long blades would not pass into the open air outside of DePasquale’s property.

According to Town Manager Michael Embury, the permit could be reinstated as early as Monday. Construction at the site of the turbine would recommence later next week, said Darlington. Though construction has been on hold for nearly two months, Darlington believes that the project is only a month behind and should be completed by the end of the year.
