Judge blocks Essex windfarm

Plans for a ten-turbine wind farm at Bradwell-on-Sea, Essex have been thrown into jeopardy after a High Court judge quashed the planning permission granted for the scheme.

Mr Justice Ouseley quashed the permission, issued by a government inspector in September last year, and ordered secretary of state for Communities and Local Government Hazel Blears to reconsider the controversial scheme.

The judge approved a formal order agreed to by Blears, who had conceded that the planning permission should not be allowed to stand, in the wake of a legal challenge brought by a local resident.

Ms Blears conceded that the permission was made subject to certain conditions, two of which contained drafting errors which could lead to them being unenforceable.

The permission had approved construction of a wind farm comprising ten turbines, with a maximum height of 121 metres to the tip of the blades, a substation building and supporting infrastructure.
