A company that wants to construct electricity-producing windmills on Penobscot Mountain has won a court battle over a zoning issue, but several obstacles remain before the firm would be able to begin construction, the company’s attorney said Friday.
The state Commonwealth Court on Friday upheld a county judge’s ruling that granted a zoning variance to Energy Unlimited regarding nine windmills. But the company still must resolve a separate legal challenge with the borough’s planning commission, which denied its plans, before construction could begin, said Matthew Turowski, attorney for Energy Unlimited.
Energy Unlimited is involved in another legal battle with the planning commission regarding construction of 25 additional windmills it wants to construct on the site. In that dispute, the Commonwealth Court overturned a county judge’s ruling that granted the company permission to build the windmills. Energy Unlimited has appealed that decision to the state Supreme Court, which has not yet ruled on the matter.
