Ethics Group to appeal ruling on wind turbines

The Wind Power Ethics Group, a citizens organization that opposes large-scale wind power development, will appeal a decision made by Judge Hugh A. Gilbert last week in regard to its article 78 lawsuit, according to a release.

Mr. Gilbert ruled that the town Zoning Board of Appeals was correct in classifying industrial wind turbines as utilities under the town’s existing zoning codes. The group filed the article 78 lawsuit challenging the decision in April. The town never adopted specific zoning regulations for wind turbines.

Wind Power Ethics Group Chairman Urban C. Hirschey said the group’s attorney will file the appeal in Rochester by today. Members of the group present at its last meeting unanimously voted to move forward with the appeal.
