A company wanting to build eight wind turbines is to appeal to the Planning Inspectorate after a council deferred its application for a third time.
Your Energy has applied for planning permission to erect the turbines near Gainsborough in Lincolnshire.
West Lindsey district council was due to discuss the Laughton development at a planning meeting on Wednesday.
But the authority removed the issue from the agenda because it said new legal issues needed consideration.
Richard Mardon, managing director of Your Energy, said: “We’ve been working on this project for five years now and we’ve done extensive studies and council officers have recommended it for approval three times.
‘Proper consideration’
“But once again the day before the meeting a letter has come in and they’ve decided to pull the project off the agenda.
“We just can’t wait in our fight against climate change. We have to do something about our energy crisis in this country.”
He added that the company would be appealing to the Planning Inspectorate about the council’s non-determination of the application.
“It will cost the taxpayers of West Lindsey probably in excess of £100,000 to defend this case,” said Mr Mardon.
In a statement the council said new legal issues which had not been considered before were received on Tuesday.
“Council officers believe those issues should receive proper legal consideration and as a result gave advice that the wind farm application should not be discussed at last night’s meeting.”
