Bureau County wind lawsuit dropped

PRINCETON – Two wind farm companies have dropped a lawsuit against Bureau County, according to State’s Attorney Patrick Herrmann.

The lawsuit was filed in February by Crescent Ridge LLC and Eurus Crescent Ridge II LLC over a proposed Crescent Ridge Wind II project. Herrmann said the companies dropped the suit this month after it was dismissed by LaSalle County Circuit Judge Joseph Hettel.

The suit claimed a decision last November to grant conditional use permits for the Crescent Ridge Wind II project did not follow the county’s zoning ordinance. Defendants in the suit were Bureau County, the Bureau County Board, Bureau County Regional Planning Commission, Bureau County Zoning Board of Appeals, Midwest Wind Energy Development Group LLC, Community Energy Inc. and Crescent Ridge Wind II.

The zoning ordinance states that conditional use permits should not be used or permitted if they conflict with the use or enjoyment of the other property in the vicinity. The two companies felt that a competing wind farm would hinder production of wind energy for the new and existing wind farms.

This month the County Board also approved a conditional use permit from Crescent Wind II LLC to install a meteorological tower in Milo Township and a permit to build an operations and maintenance building and collector substation for Crescent Ridge in Indian Township near Tiskilwa.
