Turbine debate goes to court

FREEDOM – Competitive Energy Services has decided to take the town to court in an effort to gain approval to erect three electrity-generating wind turbines on Beaver Ridge.

The Portland-based company filed an appeal in Waldo County Superior Court on Friday, near the end of the 30-day window of opportunity allowed by the town’s ordinance.

The appeals board last month overturned the planning board’s approval for the wind turbines. In rendering its decision, the appeals board determined that noise produced by the turbines would exceed the town’s ordinance standards. The board also determined that the planning board erred when it failed to require CES to post a bond for future dismantling of the turbines.

Andy Price, project manager for CES, was unsure when the appeal was first scheduled to be heard in court.
