The Ashe County Board of Commissioners will meet in emergency session at 3 p.m. today at the Ashe County Courthouse to talk with an attorney about the county’s new ordinance regulating windmills.
There is no actual emergency, but the meeting was set up on short notice because of scheduling conflicts, said County Manager Dan McMillan. Commissioners will meet with Tony Triplett, Wilkes County’s attorney.
Ashe County’s attorney, John Kilby, represented Richard Calhoun last summer when Calhoun filed an application with the N.C. Utilities Commission to develop a wind farm of 25 to 28 wind turbines in Creston. Kilby resigned as Calhoun’s attorney when public hearings about the wind farm were held in Ashe County earlier this year.
McMillan said that though Kilby doesn’t have a conflict of interest, commissioners felt it would be better to use a different attorney on windmill matters. The issue has become controversial in Ashe County. Kilby remains the Ashe County attorney on other issues.
Commissioners are reviewing the ordinance in anticipation of further meetings of the utilities commission, which is scheduled to consider the wind-farm issue in August.
