A judge has approved a decision to allow a variance to build nine wind turbines in Bear Creek Township.
Luzerne County Judge Michael Conahan on Wednesday upheld the May decision by the Bear Creek Township Zoning Board. Energy Unlimited Inc. wants to build nine turbines near Crystal Lake on 835 acres Luzerne County acquired from Theta Land Corp., in addition to building 25 turbines previously proposed for the site known as the Penobscot Mountain Wind Farm.
Last week, Energy Unlimited filed an appeal in county court to a November ruling by the township supervisors to prevent construction of the nine additional turbines.
Conahan in August overturned a decision by the township supervisors to deny the plan for 25 turbines, and that decision has been appealed in Commonwealth Court.
An environmental group, Defend Our Watershed, and three township residents appealed the May zoning ruling.
FOP attorney files motion
against Wyoming Borough
An attorney for the Fraternal Order of Police is challenging Wyoming Borough’s attempt to block a police officer from being reinstated to the force.
Officer John Broda was reinstated by an arbitrator Nov. 27 after ruling the borough erred in firing him. Broda was using a motorcycle for private use that was supposed to be police evidence.
Attorney Anthony Caputo, on behalf of the Fraternal Order of Police, argued in a motion filed Thursday the borough must abide by the arbitrator’s decision. The borough has failed to establish the facts necessary to override the arbitrator’s decision, Caputo said in the motion.
Last month, borough solicitor Mark Bufalino filed action in Luzerne County court asking a judge to intervene and throw out the arbitrator’s decision, upholding Broda’s termination. The borough believes Broda’s actions warrant termination and there is no reason for the arbitrator to rule otherwise.
