High Court deals village wind farm blow

Opponents of plans to build a wind farm outside a Norfolk village suffered a crushing blow last night in the High Court.

The High Court ruling gives Enertrag UK another chance to put forward proposals for the six-125m turbine farm at Skitfield Road outside Guestwick, near Dereham.

The court decided to overturn an earlier ruling by a government inspector to dismiss the plans.

Opponents of the scheme have warned that the turbines would be the highest in the country and would dwarf the village church tower.

The company’s application for the farm was initially refused by Broadland District Council in March 2005 and the plans were again dismissed at a planning inquiry in April 2006, after an appeal by Enertrag.

Enertrag then took its case to the High Court, leading to yesterday’s ruling that there had been a “breach of natural justice” in the earlier proceedings.

Enertrag has also been awarded costs although the figure is not yet known.
