On behalf of the Center for Biological Diversity, Friends of Blackwater, Heartwood, Adirondack Council, and Restore: The North Woods, this letter provides notice, pursuant to 16 U.S.C. § 1540(g), that the failure on the part of the action agencies – the United States Forest Service, the United States Army Corps of Engineers, the Tennessee Valley Authority, the National Park Service, the Department of Army, and the Federal Highway Administration – to re-initiate consultation as to the Gray bat, Indiana bat, Ozark big-eared bat and Virginia big-eared bat violates the Endangered Species Act.
This letter provides each of you with notice that the failure of each individual agency to reinitiate consultation violates the substantive requirements of sections 7(a)(1), 7(a)(2), and 7(d) of the Endangered Species Act. 16 U.S.C. § 1536(a)(1)(2) & (d).
Litigation can be avoided if the agencies re-initiate consultation so that each biological opinion includes an analysis of the threat of white-nose syndrome in conjunction with ongoing management activities. …
